SailScores is a free, community-driven platform for hosting, publishing, and sharing sailing race results. These Terms of Service govern your use of the service. By accessing or using SailScores, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use SailScores.

1. Purpose of SailScores

SailScores is a community-driven platform for hosting, publishing, and sharing sailing race results. Clubs and individuals may use the service to enter scores, publish regatta information, upload race-related documents (such as Notices of Race or Sailing Instructions), and view results across devices.

SailScores is not a general-purpose publishing platform. All use of the service must relate to sailing activities, race scoring, or club operations.

By accessing or using SailScores, you agree to these Terms.

2. Your Account and Responsibilities

You are responsible for:

  • The accuracy of the information you publish.
  • Maintaining the security of your account credentials.
  • Ensuring that any content you upload is lawful and that you have the rights to publish it.

You must not:

  • Misrepresent your identity or affiliation with a club.
  • Create accounts or publish content on behalf of a club without authorization.
  • Attempt to access accounts or private data belonging to others.

3. Acceptable Use

You agree to use SailScores only for lawful purposes and in ways that support the functioning and mission of the service.

You may not use SailScores to:

  • Upload or distribute illegal content.
  • Upload malicious code, spam, or content intended to disrupt the service.
  • Interfere with or overload the platform, including automated scraping or excessive polling.
  • Publish content unrelated to sailing or club activities.
  • Impersonate clubs, events, or individuals.
  • Violate copyright, trademark, or other intellectual property rights.

Examples of prohibited misuse include:

  • Publishing race results for a club without authorization.
  • Uploading documents that infringe another organization's copyrighted Sailing Instructions or Notice of Race.
  • Creating duplicate or misleading regatta pages to confuse competitors or clubs.

4. Content Ownership and License

You retain ownership of the content you upload. By submitting content to SailScores, you grant SailScores a non-exclusive license to store, display, and distribute that content as part of the service. This means we may use your content to provide the service (e.g., displaying results, archiving data, providing analytics) but we do not claim ownership of it.

You represent and warrant that:

  • You have the rights to publish any content you upload.
  • Your content does not infringe the rights of others.
  • SailScores does not claim ownership of your club's data or documents.

5. Our Right to Remove Content

SailScores may remove or disable access to content at our discretion if:

  • It violates these Terms.
  • It is unlawful or subject to a valid copyright or trademark complaint.
  • It interferes with the operation or reliability of the service.
  • It is clearly outside the scope of sailing-related use.
  • It misrepresents a club, regatta, or organization.

Examples of situations where content may be removed:

  • Two clubs dispute ownership of a regatta name or initials; we may temporarily remove or hide the content until the dispute is resolved.
  • A user uploads copyrighted documents without permission.
  • A user publishes harmful or misleading documents under another club's identity.

We may notify you when content is removed, but we are not obligated to do so. You may contact us at info@sailscores.com if you believe a removal was made in error.

7. Disputes Between Clubs or Organizations

SailScores does not adjudicate ownership of:

  • Club names
  • Club initials
  • Regatta names
  • Logos or branding

If a dispute arises:

  • We may temporarily hide or remove the disputed content.
  • We may request documentation or confirmation from the involved parties.
  • We may decline to republish content until the parties resolve the matter independently.
  • Our priority is maintaining clarity and preventing confusion for competitors and clubs.

8. Service Changes and Availability

SailScores is provided as a free community service. We may modify, suspend, or discontinue any part of the service at any time, though we will endeavor to provide notice of significant changes when possible.

We may update these Terms periodically. We will notify registered users of material changes. Continued use of the service after such changes constitutes acceptance of the updated Terms.

9. Liability and Warranty Disclaimer

SailScores is provided "as is" and "as available."

We do not guarantee:

  • Uptime or uninterrupted access.
  • Accuracy of results published by clubs.
  • Preservation of data or documents.
  • Compatibility with all devices or browsers.

To the fullest extent permitted by law:

  • SailScores is not liable for any damages arising from your use of the service.
  • SailScores is not responsible for user-generated content.
  • SailScores is not responsible for decisions made based on race results or documents hosted on the site.

10. Termination

We may suspend or terminate accounts that:

  • Violate these Terms.
  • Upload harmful or illegal content.
  • Repeatedly infringe intellectual property rights.
  • Misuse the service or interfere with its operation.

You may stop using SailScores at any time by ceasing to access the service.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
